Terms of Service
These terms govern your use of PitchPool — including your account, subscription, billing, and the pools and competitions you run or join.
Last updated:
1. Acceptance of Terms
These Terms of Service (the “Terms”) form a binding agreement between you and PitchPool(“PitchPool,” “we,” “us,” or “our”) and govern your access to and use of the PitchPool website at pitchpool.io, our applications, and related services (collectively, the “Service”).
By creating an account, joining or running a prediction pool, or otherwise accessing the Service, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase a subscription. By using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
PitchPool is a platform for organizing prediction pools and competitions of skill and knowledge. It is not a gambling or betting service, and we do not operate games of chance, accept wagers, or handle prize pools on your behalf. You are responsible for ensuring that any pool you create or join complies with the laws of your jurisdiction.
3. User Accounts
To access most features you must register for an account and may create or join an organization. You agree to provide accurate and complete information and to keep it up to date.
- You are responsible for safeguarding your credentials and for all activity that occurs under your account.
- You must notify us promptly at hello@pitchpool.io of any unauthorized use or suspected security breach.
- Organization owners and administrators are responsible for the members they invite and for the pools run under their organization.
4. Subscription Plans
PitchPool offers a free tier and paid subscription plans (such as Pro and Business) that unlock higher limits and premium features — including additional pools, larger member capacity, advanced leaderboards and statistics, and organization and tournament management tools. Enterprise arrangements are available on request.
Plan features, limits, and prices are described at the point of purchase and may change over time. Where a change materially reduces the features of a plan you are paying for, we will give you reasonable notice.
5. Billing & Payments
Paid subscriptions are processed by our payment provider, Paddle (Paddle.com Market Ltd), acting as merchant of record. When you purchase a subscription you authorize Paddle to charge your selected payment method for the applicable fees, including any taxes.
- Subscriptions are billed in advance on a recurring basis (monthly or annually) according to the plan you select.
- Unless you cancel, your subscription renews automatically at the end of each billing period, and your payment method is charged at the then-current rate.
- Prices are shown in the currency presented at checkout and may include applicable sales tax, VAT, or GST collected by Paddle.
PitchPool does not store your full payment card details. Payment information is handled directly by Paddle in accordance with its own terms and privacy policy. For billing questions, contact billing@pitchpool.io.
6. Free Trials
We may offer free trials or promotional periods for paid plans. Unless stated otherwise at sign-up:
- A trial converts to a paid subscription automatically when it ends, and your payment method is charged, unless you cancel before the trial period expires.
- Only one trial is available per user or organization, and we may withdraw or modify trial offers at any time.
7. Cancellation
You may cancel your subscription at any time from your billing settings or through the Paddle customer portal. When you cancel:
- Your plan remains active until the end of the current paid billing period, after which it will not renew.
- You retain access to paid features until the period ends, then move to the free tier.
Refunds, where applicable, are governed by our Refund Policy.
8. Acceptable Use
You agree not to use the Service to:
- Violate any law or regulation, or operate an unlawful betting, gambling, or lottery scheme through a pool.
- Infringe the intellectual property, privacy, or other rights of others.
- Upload malicious code, attempt to gain unauthorized access, probe or disrupt the Service, or circumvent usage limits.
- Scrape, harvest, or resell data from the Service, or use it to build a competing product, except as expressly permitted.
- Harass, abuse, or harm other users, or manipulate leaderboards, standings, or predictions through fraud or automated means.
We may investigate and take appropriate action, including suspending or terminating accounts, for any violation of this section.
9. Intellectual Property
The Service, including its software, design, branding, and content we provide, is owned by PitchPool and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
PitchPool is a tournament-agnostic prediction platform and is not affiliated with, endorsed by, or sponsored by FIFA or any football league, club, or governing body. Team names, competition names, and related marks belong to their respective owners and are used for identification only.
10. User Content
You may submit content to the Service, such as pool names, predictions, profile details, and messages (“User Content”). You retain ownership of your User Content.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to operate, improve, and provide the Service. You are responsible for your User Content and represent that you have the rights necessary to submit it and that it does not violate these Terms or any law.
11. Third-party Services
The Service integrates with third parties — including Paddle for payments, authentication providers, analytics tools, and sports-data sources used to power fixtures, results, and standings. Your use of those services may be subject to their own terms and privacy policies.
We are not responsible for the availability, accuracy, or conduct of third-party services, and links to third-party sites do not imply our endorsement.
12. Service Availability
We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance, updates, or events beyond our control, and sports data provided by third parties may occasionally be delayed or incorrect. We may modify, suspend, or discontinue any part of the Service at any time.
13. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, that predictions, statistics, or results will be accurate, or that the Service will be secure or free of errors.
14. Limitation of Liability
To the maximum extent permitted by law, PitchPool and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunities, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends immediately; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws applicable at PitchPool's principal place of business, without regard to conflict-of-laws principles. You agree to resolve disputes relating to the Service in accordance with this section, subject to any mandatory consumer-protection rights available to you in your place of residence.
